What each side agrees to
Four different people use this platform for four different reasons, and they are not all agreeing to the same thing. So this is written in plain terms, organised by who you are, and it says which articles actually bind you.
Last updated 18 August 2026
- A member keeps 90% of every price they set. The flat 10% fee is the same everywhere, and brand-side production fees are billed to the brand — never out of the member's share.
- No asset featuring a minor is published or delivered until the member and a parent have approved the finished asset. That gate can be withdrawn at any time without asking us.
- A booking buys a finished, licensed deliverable. It never buys source photos, contact details, or any way to reach a member or their family.
- Supporting a goal is a gift, not a purchase — it is not tax-deductible. Pledges to causes route directly to verified non-profits, never through a member.
These four sentences are a fair précis, not a softer version. Where the summary and an article disagree, the article governs.
The agreement
NIL.CARDS is a name, image & likeness marketplace for performers & creators. Members build a living card of their work, brands book them for finished content at prices the member sets, supporters fund their goals, and members can pledge a share of what they earn to verified non-profits. Using this site — browsing it, booking through it, signing a consent through it, or supporting a goal through it — means accepting these terms.
It matters what this is not. We do not sell access to children, we do not broker private contact, and no one can message a minor through this platform. Several of the obligations below exist specifically to keep that true, and we would rather lose the revenue than relax them.
Where a family has signed a consent, that consent governs what may be done with their child. Where a delivered asset carries licence terms, those terms govern that asset.
NIL.CARDS is a trading name of NIL Cards LLC, a limited liability company formed in Delaware with its principal place of business in California. “We”, “us” and “NIL.CARDS” in this document mean that company.

Talent and families
No asset featuring a minor is published, generated or delivered until a parent or guardian has signed for the member’s brand visibility and the finished asset has been approved — by the member, and by a parent for members under 18. The gates are enforced in the database rather than in the interface: a bug in our own code cannot publish a child whose family did not agree.
You can change your mind, immediately
Any permission can be withdrawn from the parent portal at any time, for any reason, without asking us first. It takes effect at once. Assets already delivered under a licence are governed by that licence and earnings already paid are unaffected — but nothing further will be published, generated or sold.
You approve the finished asset, not a promise of one
Approval applies to the actual finished asset — the image, the video, the post — not to a brief or a mock-up. Rejecting costs nothing, needs no reason, and carries no penalty. A guardian may also pre-authorise within Fast-Track limits they set, with human review and a 24-hour veto before anything goes live.
A minor cannot consent for themselves
While a member is a minor, a parent or guardian holds the permissions and cannot have that overridden by the member. On turning 18 the consent transfers to the member with a fresh affirmation, and the guardian is told their control has ended.
Your prices are yours
The member sets the price for each service and can change it at any time for future bookings. A price change never affects a booking already accepted.
What we collect about a member and how it is handled is set out in the privacy policy, which forms part of these terms.
Brands and bookings
A booking is a structured offer against a member’s published menu, at the member’s price. Payment is held by the platform when the offer is accepted and released only when the finished asset is approved — there are no invoices to chase and no work delivered on credit.
- A finished, approved deliverable — AI content, a UGC video, or a published post
- A licence with its terms attached to the asset itself
- A visible AI disclosure on every AI-generated asset
- A member's source photos, address, email or any way to contact them
- Any right to use the member's likeness beyond the attached licence
- Any right to train models on, or re-generate from, a member's likeness
- Any interaction with the member outside the structured offer flow
Brand-side production costs — AI generation, shipping labels, post verification — are billed to the brand at checkout as one bundled price. For a UGC shoot, the product ships on a platform-generated label; the member’s address is never shown to the brand.
Booking content must be suitable for the member’s age and audience. Alcohol, tobacco, vaping, cannabis, gambling, firearms, weight-loss and political messaging are not accepted for minors, and we may decline or cancel any booking we judge unsuitable. Where we cancel a booking that was not your fault, escrowed funds are returned in full.
If an approved deliverable is defective — corrupted, not as licensed, or not as described — tell us and we will make it right. A payment reversed or charged back may cancel the booking and the licence it carried.
How the money works
Every booking divides at the moment it settles, and the division is recorded in a ledger rather than calculated for display. Every figure shown to a member, a guardian or a brand is a sum over that ledger — no screen computes money on its own.
90%
of every price they set — every service, every booking. The platform fee is the flat 10% and nothing else. No plan, tier or agreement changes it.
price + costs
The member’s price plus the production costs of the booking, shown as one bundled figure at checkout. Production costs are never taken out of the member’s share.
Escrow, then release on approval
The brand's payment is held by the platform when the offer is accepted and released when the finished asset is approved. A booking rejected or cancelled before approval returns the escrowed funds.
The split is frozen at the time of booking
Whatever fee applied when a booking was accepted is the fee that booking keeps, stored on the record itself. A later change never retroactively reprices a deal that already happened.
Rounding falls on us
Where a division leaves a fraction of a cent, the member's share is rounded to the nearest cent and we absorb the remainder, so the parts always sum to exactly what was charged.
Cause pledges route directly
A member's pledge to a verified non-profit is disbursed by the platform directly to that organisation — never through the member — and the member's profile shows totals computed from real disbursements, not self-reported figures.
Refunds reverse, they do not erase
A refund writes mirrored negative entries against the original booking and adjusts the balances it touched. Because a booking belongs to exactly one member, a refund can never move another member's money.
Payouts go where a guardian authorised
A minor's earnings accrue to a balance visible to their guardian, itemised by booking, and are paid out only through arrangements the guardian has authorised. We will not pay a minor's earnings anywhere else.
Taxes are your own affair. We do not give tax advice, and members and families should assume they are responsible for their own reporting obligations on what they receive.
Supporters
Supporting a member’s goal — band camp, new equipment, a season — is a gift to that goal. It is not a purchase, it is not an investment, and it is not tax-deductible. A contribution to a member’s cause goal routes directly to the verified non-profit behind it, and whether that is deductible is between you and that organisation.
You may leave a message with a contribution. It is visible to the member’s parent or guardian and is not a channel to the member. Messages that attempt to contact, identify or arrange to meet a member will be removed and may end your ability to contribute here.
Payment is handled by Stripe; card details never reach our servers. If a goal is withdrawn before it is funded, contributions are returned. A subscription to a member’s journey can be cancelled at any time and stops at the end of the period paid for.
Non-profits
A verified non-profit can receive member pledges and run cause goals. Verification means we have confirmed 501(c)(3) status, and we re-check it annually. Funds route straight to your verified account with per-campaign reporting — never through a member, and never as cash a child handles.
Verification commits you to a short list: keep your registration current and tell us if it lapses, use received funds consistently with your charitable purpose, and never use the platform to contact a member directly — anything you want to say to a member routes through us to the guardian first.
We may pause or withdraw verification where status lapses, where reporting obligations are not met, or where we believe continued listing puts members at risk. Pledged funds already disbursed are unaffected.
What you may not do
Most of these would be obvious anywhere. They are written down because this platform is largely about minors, and because “nobody said I could not” is not a conversation we intend to have.
Contacting a member
Do not attempt to reach a member through this platform or on the strength of anything you learned from it. There is no channel for it by design, and trying to build one around us is the fastest way to lose your account.
Harvesting profiles
No scraping, bulk downloading, or automated collection of members, photographs or profile data. Cards and journey pages are for looking at and booking, not for gathering.
Using a likeness beyond its licence
A delivered asset carries its licence terms with it. Using a member's name, image or likeness outside those terms — different placements, longer periods, other products — is not a grey area; it is unlicensed use of a young person's identity.
Removing or hiding the AI label
Every AI-generated asset carries a visible, non-removable disclosure. Cropping, covering or editing it out breaches the licence and ends the relationship.
Generating anything outside a booking
A member's photos may not be used to generate anything except the asset their booking describes and their approvals allow. No off-platform generation, no derivative sets, no exceptions.
Interfering with the platform
No probing, overloading or circumventing the access controls — particularly those that gate whether a minor may be shown or delivered at all.
Who owns what
- A member's likeness
- Stays with the member and their family. A consent licenses us to use it for the specific things the consent lists, for as long as that permission stands — it transfers nothing and sells nothing.
- A delivered asset
- Licensed to the brand on the terms attached to it — placement, period and product. The licence is exactly what it says, and nothing beyond it.
- A member's journey content
- Posts, clips and showcase items remain the member's, licensed to us to display on their card and on the platform.
- A brand's materials
- Product shots, marks and briefs stay with the brand, licensed to us to produce and display the booked asset.
- The platform
- The card designs, templates, site and software are ours. A booking buys the deliverable it describes — not the design system behind it.
Safety and suspension
Anything involving a member’s safety is handled first and argued about afterwards. A takedown by a member or their guardian executes immediately — it is not a request we review before acting on. Review applies only to putting something back.
A report that someone has contacted a member goes into a dedicated queue with a 24-hour response commitment, and the guardian is notified at the same time we begin looking at it.
We may suspend or remove any account, booking, goal or listing where we believe a member is at risk, where these terms have been broken, or where we are required to. If we act against you and a member is not at risk, we will tell you why and you can reply to a person.
If you see something concerning, write to safety@nil.cards. You do not need to be sure, and you will not be treated as a nuisance for raising it.
Liability and disputes
We provide the platform as it is, and we do not promise it will always be available or entirely free of faults. What we do commit to is the specific things stated in these terms and in the privacy policy — those are obligations, not marketing.
To the extent the law allows, our liability to you for anything connected with the platform is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud. Consumer rights that apply to you by law are unaffected by anything written here.
If something goes wrong, tell us first. Nearly everything that reaches us as a dispute turns out to be a mistake we would have fixed on request, and we would rather fix it than argue about it.
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and the state and federal courts located in California have exclusive jurisdiction. NIL Cards LLC is formed in Delaware, whose law governs the company’s internal affairs, but California is where the business operates and where a dispute with a member, a family or a brand properly belongs.
If you are a California consumer, nothing here waives any right you have under California consumer protection law — those rights cannot be signed away and we are not attempting to. If any provision turns out to be unenforceable, the rest continues to apply.
Questions about any of this
If a clause here is unclear, that is our problem to fix rather than yours to decipher. Ask and we will explain it — and if the explanation is better than the clause, we will change the clause.
We will update this page and change the date below. Where a change materially affects what a family already agreed to about their child, we will not apply it quietly — we will ask for permission again.
